imPRESSive REWARDS PROGRAM

Membership Agreement

Thank you for reviewing the terms ("Terms" or "Rules") for the imPRESSive Rewards Program (the "Program"). These Terms are between You and KISS Products, Inc. and/or its affiliates ("Us" or “We”), and govern our respective rights and obligations. Your participation in the Program is subject to our Terms of Use and Privacy Policy, as well as all other applicable terms, conditions, limitations and requirements. The Terms, together with applicable terms related to any promotional offers provided to you for use with the Program, constitute the entire agreement between You and Us related to the Program. By enrolling, and continuing to use the Program, you accept these terms, conditions, limitations and requirements. We may make changes to these Terms or terminate the Program. If we make material changes or terminate the Program, we will notify you by e-mail and/or post the new terms at imPRESSmanicure.com.

Subject to these terms and conditions, VIP Club members (“Members” or “You”) will earn imPRESSive Rewards  Points (“Points”) in connection with the purchase of qualifying products at imPRESSmanicure.com and may be awarded points for participation in shares and surveys.

I. MEMBERSHIP

1. Free Membership.

No purchase is necessary to earn Points in the imPRESSive Rewards Program.  To earn Points, simply register for the VIP Club.

2. Eligibility.

You must be an individual age 13 years or older and a resident of the United States to be eligible for membership. Membership in the Program is limited to individuals only and is limited to one account per individual. Persons under the age of 18 ("Minors") must obtain their parent’s or legal guardian’s consent prior to participation. By joining the VIP Club, you agree (or, if you are a Minor, your parent or legal guardian agrees) to be bound by these terms and conditions. To enroll in the VIP Club and to be eligible for the Program, you must provide your first name, last name, gender, email address, and date of birth.  Each person may have only one VIP Club account. 

3. Opening an Account.

You may apply to become a member of the VIP Club by visiting www.imPRESSmanicure.com (the "Website").

 4. Account Maintenance.

Once you are a VIP Club member, you may view a summary of your Account on the Website. After logging onto the Website, simply click on the "My Account" link in the header of the Website homepage to change any information on your account. You may also view your imPRESSive Rewards Points balance, transaction history and eligibility for bonus offers on the Website by logging in and clicking on the "My imPRESSive Rewards" link in the profile navigation.

5. Member Cancellation.

You may cancel your imPRESSive Rewards membership at any time. Upon cancellation, any unused Points accrued in your account will be forfeited and cannot be redeemed.

II. EARNING POINTS

1. General.

Members can earn imPRESSive Rewards Points on the purchase of qualifying products and/or shares/surveys participation only at imPRESSmanicure.com. To earn Points, you must be a VIP Club Member. You must be signed into your VIP Club account to receive Points for any purchase. 

2. Earning Points.

VIP Members earn ten (10) points for every imPRESS Press-on Manicure (Retail Value $7.99) kit purchased. You may start redeeming your imPRESSive Reward Points once you have earned 100 Points. Points cannot be shared with any other VIP Club member.

  • Get 10 points for every imPRESS Press-on Manicure kit purchased
  • Refer a friend, get points
  • Take nail surveys, get points

3. Birthday Gift.

In addition to earning points on their qualifying product purchases, all VIP Club Members receive a birthday gift each year. VIP Club Members will receive a buy one get one free gift during their birthday month.  Birthday gifts may be redeemed only on imPRESSmanicure.com. When You purchase at least one imPRESS Manicure kit, You will be able to choose a birthday gift at no additional cost.  You will not be entitled to earn Points for the birthday gift.  Birthday gifts may not be returned for a refund or for credit, nor may they be exchanged.  If You return the imPRESS Manicure kit that You purchased at the time You selected your birthday gift, You will receive a credit for a future purchase.  No refund will be granted.  Your birthday gift will be shipped via USPS at our expense within 10 (ten) working days. We reserve the right to change the birthday gift product selections at any time.

4. Timing of the Addition of Points to Accounts.

imPRESSive Rewards Points earned from the purchase of qualifying products will be credited within 72 hours after shipping. The timing for issuing Points is subject to change.

5. Returns.

Points earned for a purchase that is then the subject of a return, refund, returned check due to non-sufficient funds, or other credit issue will be deducted from the Member's account in an amount equal to the Points earned for the original transaction, including any bonus Points. If a return will cause your ImPRESSive Rewards account to have a negative Point balance, a store credit will be issued on the return regardless of your original form of payment.

6. Bonus Point Promotions.

From time to time, We may run certain bonus Point promotions. Under bonus Point promotions, Members can earn additional or "bonus Points" in connection with the purchase of certain products. When these products are purchased by a Member, the Member will earn bonus Points on each product, as specified in the offer. Bonus Point promotions are subject to the terms and conditions of the offer and may be offered at any time in Our sole discretion. Bonus Point offers cannot be combined with any other offer.  You may also earn additional points on non-purchase activities at Our discretion. From time to time, We may offer the chance to win various prizes, including points. There is NO PURCHASE NECESSARY TO PLAY OR TO WIN. Rules and restrictions will apply to such promotions.

7.  Points Disputes.  If you believe that a purchase made on your VIP Club account should have resulted in the addition of Points to your Points balance, and such Points are not reflected in the Points balance of your account within forty-five (45) days of the date on which the purchase posted ("Points Dispute"), notify us immediately. We will use reasonable efforts to investigate your Points Dispute so long as You notify us of a dispute within ninety (90) days of the posting date of the purchase. If You do not notify us within the ninety (90)-day period, You will have waived your right to make a Points Dispute with respect to that purchase. In order for us to undertake an investigation of your Points Dispute, we may require You to provide written confirmation of the dispute. If We do not receive the requested written confirmation at the address and within the time requested by us, We may in our sole discretion determine not to investigate your Points Dispute. Upon completion of our investigation of your Points Dispute, We will have no further responsibilities should you later reassert the same Points Dispute.

III. REDEEMING POINTS

Points may be redeemed for products as follows:

            100 Points:  One imPRESS Press on Manicure Kit.

Points may only be redeemed in 100 Point increments.

The Member is responsible for sales tax and shipping and handling on all products purchased with redeemed Points.

Points accumulated on different VIP Club accounts may not be combined or aggregated. Points earned in a transaction cannot be redeemed in the same transaction.

IV. GENERAL

We may, in our discretion, change these Terms and Conditions, including, without limitation, the Point conversion ratio and the Point expiration policy, imPRESSmanicure.com Conditions of Use or Privacy Policy, or any aspect of Program membership. If any change to these terms is found invalid, void, or for any reason unenforceable, that change is severable and does not affect the validity and enforceability of any remaining changes or conditions. YOUR CONTINUED MEMBERSHIP AFTER WE CHANGE THESE TERMS CONSTITUTES YOUR ACCEPTANCE OF THE CHANGES. IF YOU DO NOT AGREE TO ANY CHANGES, YOU MUST CANCEL YOUR MEMBERSHIP.

A Member's Point balance, as reflected in our records, shall be deemed correct. 

We assume no responsibility for errors caused by incorrect Member information.

The sale of Points is prohibited and may result in the confiscation or cancellation of Your Points as well as suspension or termination of Your Membership, which in each case shall be final and conclusive.

We may revoke any Member's membership in the Program at any time if the Member engages in abuse of the Program or fails to follow the terms and conditions of the Program. Fraud or abuse relating to the accrual of Points or redemption of rewards may result in revocation of membership in the Program.

Points are non-transferable and cannot be redeemed for cash.

All taxes on any Points are the responsibility of the Member.

The interpretation and application of the Program's Terms and Conditions are at the sole discretion and determination of imPRESSmanicure.com.

V.  Limitation of Liability


IN ADDITION TO OTHER LIMITATIONS AND EXCLUSIONS IN IMPRESSMANICURE.COM CONDITIONS OF USE, IN NO EVENT WILL WE OR OUR DIRECTORS, OFFICERS, EMPLOYEES, AGENTS OR OTHER REPRESENTATIVES BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, OR ANY OTHER DAMAGES OF ANY KIND, ARISING OUT OF OR RELATED TO THE PROGRAM. OUR TOTAL LIABILITY, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, WILL NOT EXCEED THE TOTAL AMOUNT OF THE QUALIFYING PURCHASE THAT IS THE SUBJECT OF THE DISPUTE. THESE EXCLUSIONS AND LIMITATIONS OF LIABILITY WILL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW AND WILL SURVIVE CANCELLATION OR TERMINATION OF YOUR MEMBERSHIP. THE LIMITATIONS SET FORTH IN THIS SECTION WILL NOT LIMIT OR EXCLUDE LIABILITY FOR BEST BUY'S GROSS NEGLIGENCE, INTENTIONAL, WILLFUL, RECKLESS, OR MALICIOUS MISCONDUCT, OR FRAUD.

VI. Dispute Resolution

We and You each agree that any dispute resolution proceedings of any nature or in any forum will be conducted only on an individual basis and not in a class, consolidated or representative action. This means that You may not purport to act on behalf of a class or any other person. Likewise, an arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.

We and You each waive any right to a jury trial, unless such waiver is unenforceable. This means that any claim would be decided by a judge, not a jury.

We and You also both agree that You or We may bring suit in court to seek to enjoin infringement or other misuse of intellectual property rights.

VII.  Applicable Law

IN CONSIDERATION FOR PARTICIPATING IN THE PROGRAM, YOU AGREE THAT THE LAWS OF THE STATE OF NEW YORK, WILL GOVERN THESE TERMS AND APPLY TO ANY DISPUTES OR CLAIMS AGAINST US ARISING OUT OF OR RELATING TO YOUR PARTICIPATION IN THE PROGRAM, AND THAT ANY LITIGATION BROUGHT BY YOU RELATING TO THE PROGRAM OR YOUR PARTICIPATION IN THE PROGRAM MUST BE BROUGHT IN THE NEW YORK STATE OR FEDERAL COURTS COVERING NASSAU COUNTY, NY.
